2013: Mugshot Removal - Ga. Code Ann. 10-1-393.5: Requires mugshot companies to remove photos free of charge if an arrest is eligible for restriction or has been restricted. The websites must remove photos within 30 days of receiving a written request. Websites that fail to comply will face civil and criminal penalties. GJP​ 

"Any person who is engaged in any activity involving or using a computer or computer network who publishes on such person's publicly available website a subject individual's arrest booking photograph for the purpose of commerce shall be deemed to be transacting business in this state." GJP​.

Code Ann. 35-1-18: Prohibits law enforcement from publishing mugshots online and prevents mugshot companies from accessing booking photos for the purpose of publishing them online and charging removal fees. GJP​The Attorney General's Office of Georgia is aware of the threat the Georgia Gazette possesses to citizens of Georgia. Matthew Channing Sayle believes he is above the law. However, the citizens of Georgia can fight back and shut down the Georgia Gazette permanently. Matthew Channing Sayle obtaining images of anyone and using them to his discretion for profit is illegal. Do not be intimidated.​

"By law, the eligible individual must send written correspondence to the website company and include the individual’s name, date of birth, date of arrest and the name of the arresting law enforcement agency.  The request must be sent via certified mail, return receipt requested or statutory overnight delivery to the registered agent of the business, the principal place of business or the primary residence of the person who publishes the website.It should be noted that the law does permit a mugshot to be used in the publication or dissemination of news, commentary or advertisement by a newspaper, periodical, radio station or network, or television station or network.​We are aware of the difficulties that some consumers are experiencing in sending the demand letter to the website companies.  To avoid compliance with Georgia’s statute, many of these companies are utilizing techniques to conceal their location in an effort to thwart the receipt of consumer correspondence.  For this same reason, ultimate enforcement action by this office may prove difficult.Because of the problems with these companies, this issue is now a growing concern at the national level.  In order to bring more attention, and hopefully, more resources to this problem, we encourage you to file an additional online complaint with the Internet Crime Complaint Center (IC3) at www.ic3.gov.  IC3, which only accepts complaints regarding Internet crimes, is co-sponsored by the Federal Bureau of Investigation (FBI) and the National White Collar Crime Center (NW3C).  Both of these agencies are actively seeking consumer submissions regarding their experiences with mugshot websites."​
