The request must be sent via certified mail, return receipt requested or statutory overnight delivery to the registered agent of the business, the principal place of business or the primary residence of the person who publishes the website.It should be noted that the law does permit a mugshot to be used in the publication or dissemination of news, commentary or advertisement by a newspaper, periodical, radio station or network, or television station or network.We are aware of the difficulties that some consumers are experiencing in sending the demand letter to the website companies. To avoid compliance with Georgia’s statute, many of these companies are utilizing techniques to conceal their location in an effort to thwart the receipt of consumer correspondence. For this same reason, ultimate enforcement action by this office may prove difficult.Because of the problems with these companies, this issue is now a growing concern at the national level. In order to bring more attention, and hopefully, more resources to this problem, we encourage you to file an additional online complaint with the Internet Crime Complaint Center (IC3) at www.ic3.gov. IC3, which only accepts complaints regarding Internet crimes, is co-sponsored by the Federal Bureau of Investigation (FBI) and the National White Collar Crime Center (NW3C). Both of these agencies are actively seeking consumer submissions regarding their experiences with mugshot websites."
